Can Area Damage Ability damage non-flag player?

My flag was off killing mobs for quests in Kingdom of Element and a Scout with flag on use Rain Arrow on me.

And it killed me.

Is that possible? if your flag is off and can someone use area damage? is it cause he has that "PVP Item Flag" on?

If he had Warbanner on (shown as a flag on map), then he can kill anyone regardless of the target's icon flag. If he didn't have warbanner but simply had his flag red, the scout shouldn't have been able to kill you. It may be a bug.. I remember in earlier patches years ago when summoner's wandering fever could affect non-flagged players, which it shouldn't have done.
