From the highest to the lowest player in the group may no more than 5 levels in between.

49 - 38 = 11 which is too much

If you buy the best friend feature with your friend, your friend can help you with any instance no matter of the level difference. The lower your level is when you buy it, the cheaper it is in gold :) Just make sure neither of you have 2 best friends existing since that's the maximum limit per toon.
